3. Pricing and VAT
Prices are shown excluding VAT. Applicable VAT based on the Client's country will be added at checkout. B2B clients with a valid EU VAT number may be subject to reverse charge.
4. Payment and Billing
Payments are processed by Stripe (PCI-DSS certified). Syvel does not access card details. An invoice is automatically issued at each renewal.
5. Subscription and Automatic Renewal
Subscriptions renew automatically on a monthly basis, charged to the registered payment method on the billing cycle anniversary date.
6. Cancellation and Right of Withdrawal
Cancellation can be done at any time from the dashboard. Cancellation takes effect at the end of the current billing cycle — no pro-rata refund is issued.
Consumer clients have a 14-day withdrawal right from subscription date, provided the Service has not been used. Contact: [email protected].
7. Rate Limits and Quotas
7.1 Monthly Quota
When the monthly quota is exhausted, the API returns a 429 Too Many Requests error. It is the Client's responsibility to implement fault-tolerant logic (e.g. a Fail-Open strategy). Syvel cannot be held liable for any loss of revenue, leads, or signups due to quota exhaustion, where the Client has not implemented such fault tolerance.
Email alerts are sent at 80% and 95% quota usage to help the Client anticipate.
7.2 Network Rate Limit
Syvel's infrastructure applies a network-level rate limit of 100 requests per second on average, with a burst of 200 requests per second. Exceeding this may result in a temporary 429 response, independently of the monthly quota.
8. Limitation of Liability — False Positives
Syvel provides a risk score (0–100) and indicators (including is_risky) as a decision aid, not as an automated decision. No email validation algorithm is 100% reliable.
The final decision to block or accept a user belongs exclusively to the Client. Syvel cannot be held liable for:
- Loss of revenue due to blocking a legitimate customer (false positive).
- Loss due to accepting a fraudulent address (false negative).
- Any decision made by the Client based on API results.
9. Price Changes
Syvel may modify pricing with at least 30 days' email notice. The Client may cancel without penalty before the new pricing takes effect.
10. Governing Law
These General Sales Terms are governed by French law. Disputes shall be subject to the jurisdiction of competent courts in France.
